2. Where is this Privacy Policy applicable?

This Privacy Policy applies to the websites, applications, events, and other services we offer under the YDestiny brand. Regardless of why you register for our services, this Privacy Policy applies. For clarity, we will simply use the term “services” to refer to all these elements.

If any of our services require a separate Privacy Policy for any reason, that policy will be made available to you and will apply instead of this Privacy Policy.

3. The Information We Collect

To offer you profiles that meet your needs, we will collect information about you as well as the categories of people you wish to meet.

Information You Provide

Basic information for setting up your account is provided when you create a personal account, such as your email address, date of birth, address, and password.

When you complete your profile, you have the option to share additional details about yourself, such as your gender, preferences, approximate location, etc. In some countries, some of this information may be considered sensitive or specific (for example, sexual orientation, medical data, or ethnic origin). At the end of each section regarding your personal information, a question will appear: “Do you agree that this information can be shared with compatible profiles?” By providing this information, you agree that we may use it in accordance with this Privacy Policy.

You may also share photos, videos, audio content, text, and other types of content, including your interactions with other members.

When you make a purchase, we retain the transaction details (e.g., what you bought, the purchase date, and the price). The specific information may vary depending on the payment method you choose. If you make a payment directly with us (rather than through a platform like iOS or Android), you must provide your debit or credit card number or other financial details.

Occasionally, we conduct (i) surveys, focus groups, or market studies for research purposes and (ii) promotions, events, or contests for marketing purposes. When you decide to participate, you provide us with information to process your registration and participation, as well as your responses and feedback.

When you choose to provide information about third parties (for example, if you use someone else’s contact details for a specific feature or submit a request or report involving a member), we process that information on your behalf to address your request.

You provide customer service information when you contact us, which may be essential for addressing your inquiry. You might also receive inquiries or reports from third parties.

When permitted by law, we may also receive information from third parties regarding individuals suspected or known to have committed wrongful acts, as part of our efforts to ensure the safety of our members.

You may share information with us using your accounts on other platforms (such as Spotify, Google, or Apple). For example, if you choose to create and log in to your account via these platforms, or if you choose to import data such as a playlist from these platforms into our service.

Information Collected Automatically

By using the service, we collect information about your activity, such as the date and time of your logins, the features you use, your actions within the service, the information displayed to you, referring web pages, advertisements you interact with, and your interactions with other users (e.g., search, matching, communication). You may also provide us with details about your interactions with our ads on third-party websites or apps.

The use of the service requires the collection of data from the device(s) you use to access our service, such as hardware and software details (IP address, device identifier and type, app settings and characteristics, app crashes, advertising identifiers, and other identifiers related to cookies or other technologies that can uniquely identify a device or browser). Other information we collect with your consent:

A copy of your official ID is required to verify your identity.

Recording your interview during an in-person meeting will be captured on video. By participating in the meeting, you consent to the audio-video recording of the entire session. We will process this video internally and will not share it with other registrants.

During the meeting, one of YDestiny’s advisors may suggest that you create a short introductory video to present yourself to compatible profiles. You can choose whether or not to allow the creation of this video.

YDestiny will always seek your consent before disclosing your information to other profiles.

4. How and Why We Use Your Data

The processing of your data is primarily driven by the provision of our service and its continuous improvement. This includes connecting you with compatible profiles, personalizing your experience, and allowing you to fully enjoy our service. We also manage your information to ensure your safety and that of all our members while using our service. We take this responsibility very seriously and are continually improving our systems and processes to ensure your security. Additionally, we use your information to provide you with relevant advertisements – which you can manage in your settings. The purposes of our services include:

  • A. Managing your account and providing our services:
    • Create and manage your account.
    • Provide customer service and meet your needs.
    • Communicate with you regarding our services.
    • Personalize pricing, special offers, promotional deals, and process transactions.
    • Manage raffles and contests.
  • B. Assisting you in connecting with other users:
    • Recommend profiles to you and enable others to recommend you.
    • Display members’ profiles to one another.
    • Allow members to find and contact each other.
  • C. Introducing you to new YDestiny services:
    • Registration and publication of your profile to inform you about new features and applications.
    • Managing your account in relation to these new features and applications.
  • D. Suggesting promotions and overseeing advertising and marketing campaigns:
    • Executing and evaluating the performance of advertising campaigns on our services, as well as marketing our services externally.
    • Communicating with you about products or services that might interest you.
  • E. Improving our services and creating new ones:
    • Conducting focus groups, market research studies, and surveys.
    • Reviewing interactions with customer service to enhance our service quality.
    • Understanding how our members use our services to drive improvements (for example, modifying the appearance or interface of a feature based on feedback).

    • Identifying and resolving violations, suspected or alleged, of our Terms of Use by reviewing reports and communications between members.

    • Retaining information about violations to prevent recurrence.
    • Exercising our rights as outlined in our Terms of Use.
    • Contacting individuals who report issues, including informing them of the measures taken.

  • Service Provision: We use your information for purposes A, B, and C to fulfill the contract between us and you. For example, in our dating services, we use your data to manage your account and profile, make them accessible to other members, recommend profiles, and offer both free and paid features.

Since our goal is to support you in your dating journey, we primarily share your information with other members.

Sharing with Other Members

When you voluntarily disclose information on the service (including your public profile), you are sharing that information with other members. Please exercise caution and ensure the content you share is visible.

If you choose to restrict the audience for all or part of your profile or for certain content or information about you, it will be visible only according to your preferences.

If someone reports an issue (for example, if you are reported for not complying with our Terms of Use), we may share the actions taken in response, if necessary.

With Our Service Providers and Partners

We engage service providers to assist us in operating, distributing, marketing, and improving our services, such as hosting and data maintenance, analytics, customer support, marketing, advertising, payment processing, and security operations. We also share information with providers who help promote our services. For example, we may provide our advertising partners with limited, hashed information that is difficult for humans to decipher.

Prior to contracting a provider or partnering with a collaborator, we conduct a rigorous screening process. Our providers and partners are required to comply with strict confidentiality requirements.

Sharing Features

Our service may allow members to share their data, enabling them to share it outside our platform using sharing functionalities.

For Business Transactions

If we are involved, in whole or in part, in a merger, sale, acquisition, transfer, restructuring, reorganization, dissolution, bankruptcy, or other changes in ownership or control, we may transfer your information.

With Your Consent or At Your Request

In these situations, non-personal data (i.e., data that does not by itself identify you, such as device information, general demographic data, general behavioral data, or anonymized location) and personal data in a hashed, unreadable form may be used and shared. We may also share this data with other companies and third parties (particularly advertisers) to create and display targeted ads on our service as well as on third-party websites or apps, and to perform analytics and reporting on the ads you see.

It is important that you retain control over your information. Below are the various options and tools available to you:

  • Access and Update Tools: Your account settings allow you to access, correct, or delete the information you provided. If you have questions about these tools, please contact our customer service.
  • Device Permissions: Mobile platforms may have permission systems for specific types of data and device notifications (e.g., contacts, photos, location services, push notifications, and advertising identifiers). You can adjust your device settings to allow or refuse the collection or processing of such information, although this may limit certain features.
  • Uninstallation: Uninstalling an application stops the collection of information via the standard uninstallation process. Note that uninstalling an app does not delete your account. To deactivate your account, please use the appropriate feature within the service.
  • Account Deletion: You can delete your account directly using the feature provided in the service.

We also want to inform you of your privacy rights:

  • Access: You may request a copy of the data we hold about you, and in some cases, receive it in a portable file format.
  • Deletion: You have the option to ask us to remove the personal data we hold about you by submitting a request.
  • Modification/Correction/Update: Most of the information you provided can be corrected by editing your profile directly in the service. If you believe the information we have is incorrect, please contact us to have it amended.
  • Objection: You have the right to object to certain processing or request that we restrict it. To do so, please contact us.

To ensure your security and that of our members, we may ask you to verify your identity before processing these requests. We reserve the right to refuse a request if we cannot verify your identity, if the request is illegal or invalid, or if it may violate trade secrets, intellectual property, confidentiality, or other rights.

If you wish to obtain information about another member (for example, a copy of all messages you have received from them via our service), the other member must provide their written consent before the information can be shared. We may also ask for proof of identity from the other member.

Additionally, we may be unable to accommodate requests that would restrict or limit the processing of personal information, particularly when such requests would prevent us from providing our services (for example, if we do not have your date of birth, we cannot verify that you are over 18).

In some countries, such as the European Economic Area and the United Kingdom, you have the right to file a complaint with the relevant data protection authority if you have concerns about how we process your personal information. 8. Data Retention Period

Your personal data is retained only as long as necessary for legitimate business purposes and to the extent permitted by applicable law. If you stop using our services, you have the option to delete your account, and your profile will no longer be accessible to other members. Please note that if your account remains inactive for two years, it will be automatically deleted. Once your account is deleted, we will remove your personal data as follows:

  1. To ensure the safety and security of our members, we implement a security retention period of three months after account deletion or one year after an account is banned. During this period, we retain your information in case we need to investigate illegal or harmful behavior. The retention during this security period is based on our legitimate interest and that of any third-party victims.
  2. After the security retention period, we will erase your data and only retain limited information for specific purposes:
    • a) We limit data retention to comply with our legal obligations: transaction details are kept for 10 years to meet tax and accounting regulations, credit card information is retained for the period during which a user may dispute a transaction, and “traffic data” or logs are kept for one year to comply with legal data retention obligations. Additionally, we retain records of consent for a period of five years to demonstrate compliance with applicable laws.
    • b) Based on our legitimate interest, we retain limited information: customer service records and supporting data, as well as approximate location data for downloads/purchases, for five years to support customer service decisions, enforce our rights, and defend against claims. Information regarding previous accounts and subscriptions is retained but deleted three years after the last account is closed, to ensure accurate financial forecasting and reporting. Profile information is retained for one year in case of potential legal disputes, to establish, exercise, or defend legal claims. Finally, we retain information necessary to prevent banned members from opening a new account, as long as needed to ensure the safety and protect the interests of our members.
    • c) Finally, we retain information based on our legitimate interest in the event of an issue, potential or confirmed claim, or litigation that requires such retention. This includes situations where we receive a valid legal subpoena or data preservation request (in which case we must retain the data to comply with our legal obligations) or when data is otherwise required in the context of legal proceedings.

9. Minors Are Not Allowed

Our services are intended for individuals aged 18 or older. Users under 18 cannot access our platform. If you believe a member is under 18, please use the reporting system available within the service.

10. Changes to the Privacy Policy

In our constant pursuit of innovative methods to help you establish authentic relationships, and our commitment to keeping our data practices up to date, this Privacy Policy may be modified from time to time. Each member is responsible for reviewing the updated Privacy Policy.
